EULA - End User License Agreement

This "end-user license agreement" (EULA) is a legal agreement between you and Freebyte Software Engineering which allows you, the end user, to use our software under the terms and conditions which are defined below. If you cannot agree to abide by the terms and conditions in this agreement you should not install, use or evaluate the software.
You are invited to evaluate the shareware version for 21 days. Once you have decided that you
want to use the program beyond that period you need to register it at http://www.treepad.com

DEFINITIONS.

"Producer", "Freebyte", "we" or "us" means the company which has produced the software and which is the owner of its copyright, which is:

"User" or "you" means the Software customer or "end user" of the program.

"Program" or "software" means the software products created by Freebyte which you have used, purchased or obtained for evaluation or which are offered for download on TreePad.com .

"Trial Copy" means a time-limited copy of the program, distributed for evaluation purposes and which is described as a trial, shareware, evaluation copy or unregistered copy.

"Registration key" refers to the unique software registration code that you have received or will receive after program purchase and which converts a trial copy of the program into a fully functional, time-unlimited copy.

RESTRICTIONS. The user shall not rent, distribute or sublicense the original or any copy of the software and the manuals. He may not edit, modify, hack or decompile the software. He shall not edit the structure of the software, nor ask to any other person to do so in order to modify its properties. The license will immediately terminate without notice if the user fails to comply with any provision set forth herein. The user may not use the trial copy for purposes other than evaluation of the program.

DISCLAIMER OF RESPONSABILITY. The Software is provided "AS IS" and without warranty of any kind.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY. Freebyte shall not be liable for any loss of profits, loss of business, loss of information, personal injury, indirect, special, incidental or consequential damages, expressly or not set forth herein incurred before, during or after the use of our products. Any liability of Freebyte will be limited exclusively to product replacement or refund of purchase price. Except as set forth above, no other warranties, either express or implied, including the warranties or conditions of merchantability and fitness for a particular purpose are applicable to this product or any of the other products which are created by us and are offered for download on TreePad.com.

SOFTWARE LICENSE. After you purchase the program, you will receive a unique software registration key. You may not publish or distribute the registration key in any manner without direct authorization from us. If you do, your license to use the program is automatically terminated, you must remove the program from your computer(s), and you may be liable for legal damages. The software license allows installing the program on a second (or third, etc.) computer using the same registration key, without having to purchase a second license, IF (and ONLY IF) the program on that second (or third, etc.) computer is used by the same individual on both computers exclusively. In all other cases additional registration keys for the program need to be purchased.

DISTRIBUTION You may freely distribute trial copies of the program, in its original format, so long as you do not charge more than a nominal fee to cover the cost of materials. You may not in any way change the original distribution file, except to package it within another archive if necessary.

CONTROLLING LAWS. This agreement is governed by the laws of the country of residence of the software producer, and by international treaty provisions, also for what concerns patent and copyright. The terms of use set forth in these legal notices and any claims relating thereto shall be governed and construed in accordance with the laws of the The Netherlands, without giving effect to the conflict of laws provisions thereof or of any other jurisdiction. You agree and hereby submit to the exclusive personal jurisdiction and venue of the Superior Court of The Netherlands, with respect to any claims arising out of or relating to the terms of use set forth in these Legal Notices or your use of this software.

INTELLECTUAL PROPERTY OWNERSHIP, COPYRIGHT PROTECTION. The software and any authorized copies that you make are the intellectual property of Freebyte. The software is protected by law, including without limitation the copyright laws of the Netherlands, other countries, and by international treaty provisions. This agreement does not grant you any intellectual property rights in the software and all rights not expressly granted are reserved by Freebyte.
